Terms and Conditions

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal authority to enter into these Terms on behalf of yourself or, if applicable, your organization.

2.1 Registration

You may use certain features (anonymous scans) without an account. A registered account is required to save scan history, set up monitoring, access compliance reports, and use paid features.

2.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

2.3 Accurate Information

You agree to provide accurate information when creating your account and to keep it current.

CookieGap is a privacy compliance analysis tool. It scans websites you provide to identify cookies, consent management behavior, and potential compliance issues under regulations such as GDPR, CCPA, ePrivacy, LGPD, and PIPEDA.

3.1 What the Service Is

• A diagnostic and informational tool that helps you identify privacy compliance issues on websites
• A reporting tool that generates compliance scores and human-readable recommendations

3.2 What the Service Is Not

• Legal advice. The Service does not constitute legal advice. Compliance scores, grades, and recommendations are generated algorithmically and by AI models. They are informational only and do not create an attorney-client relationship.
• A guarantee of compliance. A high score or "passing" grade does not mean your website is fully compliant with any law. Laws change, enforcement interpretations vary, and the Service cannot cover every possible compliance dimension.
• A complete audit. The Service scans publicly accessible web content. It cannot access authenticated pages, mobile apps, server-side tracking, or configurations invisible to a browser. See cookiegap.com/guides/scope for a plain-language description of what is and is not detected.

You are solely responsible for ensuring your own legal compliance. We recommend consulting a qualified attorney or data protection officer for compliance decisions.

You agree not to use the Service to:

• Scan websites you do not own or do not have explicit authorization to scan
• Attempt to overwhelm, crash, or interfere with the Service or its infrastructure
• Reverse-engineer, decompile, or extract the source code of the Service
• Circumvent any rate limit, concurrency cap, or subscription restriction
• Use automated scripts to interact with the Service except through our official API (if and when made available)
• Use the Service to generate, store, or transmit illegal content
• Resell or sublicense access to the Service without our written permission
• Misrepresent scan results as official legal assessments or certifications

We reserve the right to suspend or terminate accounts that violate these restrictions without refund.

5.1 Plans and Pricing

Prices are in US dollars and subject to change with notice (see Section 5.6).

5.2 Billing

Billing is handled by Paddle(paddle.com), our merchant of record. When you subscribe or make a one-time purchase, you agree to Paddle's terms of service in addition to these Terms. Subscription charges are applied at the beginning of each billing period. One-time purchases (such as Scan Packs) are charged immediately at the time of purchase.

5.3 Scan Limits

Monthly subscription scan limits reset at the start of each calendar month. Unused monthly scans do not roll over. If you reach your monthly limit, you will be prompted to upgrade or purchase a Scan Pack — scans will not be processed until the next reset, an upgrade, or available Scan Pack balance.

Scan Pack scans do not expire and are consumed after your monthly quota is exhausted, or immediately when a geo-targeted scan is requested on the Free plan. Failed scans do not count against any quota. Scan Pack scans cannot be used for domain scans (multi-page crawls) or scheduled monitoring — a subscription is required for those features.

5.4 Cancellation

You may cancel your subscription at any time from Dashboard → Billing. Cancellation takes effect at the end of your current billing period, and you retain access to paid features until then. Refunds are governed by our Refund Policy in Section 16.

5.5 Refunds

You may request a full refund within 14 days of any purchase. See our Refund Policy in Section 16 for how to request one.

5.6 Price Changes

We will provide at least 30 days' notice before increasing prices for existing subscribers. Notice will be delivered by email and/or by a notice in the Service. Your continued subscription after the change takes effect constitutes acceptance of the new price.

5.7 Taxes

Prices may not include applicable taxes. Paddle, as our merchant of record, is responsible for collecting and remitting sales tax, VAT, and GST where required. Any such amounts will be shown at checkout.

6.1 Our IP

CookieGap, including the website, scanning engine, compliance algorithms, grading methodology, reports, and all associated content, are owned by Retegio LLC and protected by copyright, trade secret, and other intellectual property laws. These Terms do not transfer any ownership rights to you.

6.2 Your Content

You retain ownership of the URLs, domains, and any other content you submit to the Service. By submitting content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.

6.3 Feedback

If you provide feedback, suggestions, or bug reports, you grant us a royalty-free, perpetual license to use that feedback to improve the Service without any obligation to you.

Our collection and use of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

The Service relies on third-party providers including Supabase, Paddle, Resend, Anthropic, and Google. These providers have their own terms and privacy policies. We are not responsible for the conduct of third-party services.

Any links from the Service to third-party websites are provided for convenience. We do not endorse and are not responsible for the content or practices of third-party sites.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Scan results will be accurate, complete, or legally sufficient
• Any particular website will be determined compliant or non-compliant under any law

To the fullest extent permitted by applicable law, Retegio LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you for direct damages will not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim or (b) $100 USD.

Some jurisdictions do not allow limitations on liability. In those jurisdictions, the above limitations apply to the fullest extent permitted.

You agree to indemnify and hold harmless Retegio LLC and its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your violation of any applicable law.

12.1 By You

You may close your account at any time via Dashboard → Settings → Delete Account. This permanently deletes your scan history and account data.

12.2 By Us

We may suspend or terminate your access to the Service immediately and without notice if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Upon termination, your right to use the Service ceases immediately.

12.3 Effect of Termination

Sections 6, 9, 10, 11, 13, and 14 survive termination.

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles.

Any dispute arising from these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.

Informal resolution first. Before filing any claim, you agree to contact us at [email protected] and give us 30 days to attempt to resolve the dispute informally.

We may update these Terms from time to time. When we do, we will update the "Last reviewed" date at the top. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service and delete your account before the effective date.

Entire agreement. These Terms (and our Privacy Policy) constitute the entire agreement between you and Retegio LLC regarding the Service.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights freely, including in connection with a merger or acquisition.
